Cancellation & Refund Policy

1. Membership Cancellation
Members may cancel their membership subject to the following terms:

Month-to-Month Memberships:
Cancellation requires a minimum of 30 days’ written notice prior to the next billing date. -
Term Memberships (e.g., Annual Agreements):
Members are responsible for the full term of the agreement unless canceled in accordance with Nevada law and the provisions below. -
All cancellation requests must be submitted in writing via:

In person at the facility

Verbal cancellations will not be accepted.
2. Nevada Statutory Cancellation Rights (NRS 598.700 – 598.787)
In addition to SVG3 Fitness policies, members are entitled to the following rights under Nevada law:

3-Day Right to Cancel:
You may cancel this agreement within three (3) business days after signing by providing written notice. You are entitled to a full refund of all monies paid within this period. -
Death or Disability:
If a member dies or becomes totally and permanently disabled during the membership term, the agreement may be canceled.-
A pro rata refund of unused services will be issued upon receipt of appropriate documentation.

Relocation:
If a member relocates their residence more than 25 miles from SVG3 Fitness and is unable to transfer the membership to a comparable facility, the agreement may be canceled.-
Proof of relocation is required.

A pro rata refund may be issued.

Facility Closure or Relocation by Business:
If SVG3 Fitness permanently closes or relocates more than 25 miles from its current location and fails to provide comparable facilities, members are entitled to cancel and receive a pro rata refund.
3. Early Termination (Outside Statutory Rights)
If a member requests early termination outside of the conditions required by Nevada law:

Approval is at the sole discretion of SVG3 Fitness

An early termination fee may apply (e.g., remaining balance or a flat fee of $[insert amount])

Any approved refund will be prorated and may be subject to processing fees
4. Refund Policy

All membership fees are non-refundable, except where required by Nevada law (as outlined above), including:

Monthly dues

Annual fees

Enrollment/initiation fees

No refunds will be issued for:

Unused time

Missed visits or sessions

Failure to utilize the facility

Prepaid services (personal training, recovery sessions, etc.):

Non-refundable after 7 days from purchase or after use begins

Any approved refunds will be prorated and may include a processing fee

5. Billing & Failed Payments

Members must maintain valid payment information on file.

Failed payments may result in:

Late fees
-
Suspension of membership access
-
Termination of agreement

SVG3 Fitness reserves the right to pursue collection of any outstanding balances as permitted by Nevada law.
6. No-Show / Late Cancellation Policy
For personal training and recovery services:

Minimum 24 hours notice required for cancellations

Late cancellations or no-shows will result in:
-
Loss of session
-
Full charge applied
-
7. Membership Freeze Policy

Minimum freeze: 14 days
-
Maximum freeze: 90 days per calendar year
All freeze requests must be submitted in writing and approved by management.

8. Consumer Protection Notice (Nevada Requirement)
This agreement is subject to the provisions of Nevada law governing health clubs (NRS 598.700 to 598.787). Any waiver of rights provided under these statutes is void and unenforceable.
9. Policy Modifications
SVG3 Fitness reserves the right to update or modify this policy at any time in compliance with applicable Nevada and Clark County regulations.
